Case summary

On June 3, 2024, the Division Director of ECAD, EPA R3 issued an Administrative Order for Compliance on Consent ( Order ) under Section 309(a) of the Clean Water Act ( CWA or Act ), 33 U.S.C.1319(a) to Hill Mobile Home Park, LLC, for violations of its National Pollutant Discharge Elimination System (NPDES) permit. Respondent owns and operates the Hill Mobile Home Park Sewage Treatment Plant ( STP or Facility ), a privately owned wastewater treatment plant located at the Intersection of Lakewood Road and A.P. Hill Boulevard, Bowling Green, Virginia. The STP discharges treated domestic wastewater at Outfall 001 to an unnamed tributary to Maracossic Creek, which flows to the York River, which flows to the Chesapeake Bay, a navigable water. The STP is subject to NPDES Discharge Permit No. VA0090689 (?Permit?), issued by VADEQ, effective August 1, 2022, with an expiration date of July 31, 2027. Discharge Monitoring Reports submitted by Respondent revealed that the Facility had 72 exceedances for the period of 8/1/2022 to 03/31/2023. Additional violations include failure to maintain the Facility and Systems of Control to achieve compliance, and failure to maintain and follow a current Operation and Maintenance Plan. Taken together, these failures constitute a violation of Section 301(a) of the CWA, 33 U.S.C.1311(a), and of the NPDES General Permit for Discharges of Stormwater from Construction Activities (Permit). Currently, Respondent is pumping and hauling waste from the Facility and has agreed to prepare a Corrective Action Plan to bring the Facility into compliance.
