Case summary

On Aprill 7, 2025, Region 3 issued a CAFO that commenced and concluded a matter against Frederick-Winchester Service Authority and Frederick County Sanitation Authority dba Frederick Water, the owner and operator, respectively, of the Crooked Run wastewater treatment plant located 130 Crappie Court, Front Royal, Virginia 22630 (the Facility ). The Facility experienced 60 effluent limit exceedances for nitrogen, chloride, and biochemical oxygen demand. The CAFO settles the violations with a civil penalty of $12,000. The CAFO was subject to public comment, and there were 346 comments. The EPA received a timely petition to set aside the CAFO. After determining not to withdraw the CAFO, the EPA requested the Office of Administrative Law Judges (\ OALJ ) to assign a petition officer. The OALJ issued an Order Designating Petition Officer and Requiring Answer which the EPA provided. The assigned petition officer issued an Order Denying Petition to Set Aside Consent Agreement and Proposed Order. The EPA consulted with the Virginia Department of Environmental Quality during the development of this action.
