On January 2 the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA Subtitle I violations and violations of West Virginia?s underground storage tank (UST) program by T & D Quick Stop, Inc., as the tank owner and operator, of USTs at the T & D Quick Stop facility located at 267 US-52 East, in Kermit, West Virginia. Region 3's enforcement team, in coordination with WVDEP, was able to resolve the UST violations of failing to conduct tank and piping release detection on one of their USTs for three months between 2022 and 2023. The violations were discovered through an UST Compliance Inspection conducted on May 17, 2023, and through follow-up information gathering. The respondent has agreed to pay a $2,444 penalty and has returned to compliance with the violations.
