Case summary
On April 23, 2024, EPA Region 3 entered into a Consent Agreement and Final Order with Moser's Repair and Performance, LLC ( Moser's ) resolving alleged violations of the CAA-Title II, in accordance with EPA's Vehicle & Engine Civil Penalty Policy for stopping the tampering from After Market Defeat Devices. Specifically, EPA alleged that Respondent sold and/or installed at least thirty-five (35) Aftermarket Defeat Devices on several on-road vehicles. Mosers agree to pay a civil penalty and to cease from the sales and installation of aftermarket parts that affect vehicle emission control systems. The Maryland Department of Environmental Protection is aware of this action. The settlement requires Respondent to pay $6,000 in civil penalties to resolve the alleged violations.
