Case summary

On February 13, 2024 EPA Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against OMNOVA North America, Inc. ( OMNOVA ) located at 95 Hickory Drive, Auburn, PA 17922 ( Facility ) for alleged violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Pennsylvania Hazardous Waste Management Regulations discovered during a Compliance Evaluation Inspection. OMNOVA manufactures extruded specialty laminates and films for commercial use in furniture, cabinetry, flooring and other architectural or automotive applications at the Facility. The violations in the settlement include: 1) operation without a hazardous waste permit or interim status; (2) failure to properly prepare a biennial report; (3) failure to maintain an adequate contingency plan at the Facility; (4) failure to maintain written hazardous waste management job descriptions at the Facility; (5) failure to provide RCRA training; (6) failure to submit land disposal restriction forms; (7) failure to keep containers of hazardous waste closed during storage; and (8) failure to label/date containers of universal waste. The Facility is not in an area of potential EJ concern. Region 3 notified PADEP, which had no objections to this action. Per the terms of the Consent Agreement, OMNOVA will pay a civil penalty in the amount of $35,068.00.
