Case summary
On December 05, 2023, Region III entered into a Consent Agreement with, and issued a Final Order with an Expedited Settlement Agreement (ESA) to Agilent Technologies; settling violations of RCRA Subtitle C that EPA inspectors observed during an inspection of the company's facility in Wilmington, Delaware (Facility). The settlement will ensure that, in the future, the company will properly contain and manage hazardous waste at the Facility. During the inspection of the Facility, and through subsequent communications, the EPA inspectors observed that the company: (1) Failure to Operate with a Permit, Interim Status, or Valid Exemption to Permit Requirement (2) Failure to Make a Waste Determination (3) Failure to Keep Containers of Hazardous Waste Closed (4) Failure to Properly Label Universal Waste Lamps. The Company has agreed to pay a penalty of $5,000 to settle the enforcement action and refined its procedures for handling waste at the facility. The Consent Agreement and Final Order initiate and resolve this enforcement action. EPA informed PADEP of the action by letter on June 23, 2023 and received no objection.
