Case summary
On November 15, 2023, Region 3 entered a Consent Agreement and Final Order with the Maryland Department of Public Safety and Correctional Services ( Respondent or DPSCS ), for RCRA underground storage tank (UST) management violations at its Southern Maryland Pre-Release Unit ( Facility ). The respondent is the owner and operator of petroleum products for use at the Facility, located at 14320 Oaks Road, Charlotte Hall, MD 20622. The violations involved failure to provide tank release detection and line tightness testing records for a gasoline-containing 1,000-gallon UST for more than three (3) years. Such violations can potentially lead to petroleum product leaks which can be harmful to both human health and the environment. The Maryland Department of the Environment was provided notice of the planned enforcement action and had no objections. The settlement required the respondent to certify that it is now in compliance with applicable UST requirements, which included closure and removal of the UST, and to pay a $30,000 penalty. The facility is not located in an area of potential EJ concern.
