Case summary

On March 22, 2024, a Consent Agreement and Final Order entered into by EPA and Entegris, Inc.( Respondent ) was filed with the Regional Hearing Clerk settling alleged violations of the Resource Conservation and Recovery Act ( RCRA ). The violations were discovered as a result of a February 4, 2020 RCRA Subtitle C compliance evaluation at Respondent's facility located at 800 W Front Street in Chester, Pennsylvania. As alleged in the Consent Agreement and Final Order, Respondent's compliance issues include operating a hazardous waste storage facility without a permit or interim status, failing to make hazardous waste determinations, failing to identify a primary emergency coordinator, failing to transfer waste from containers not in good condition, failing to keep containers closed when not adding or removing waste, and failing to properly manage universal waste lamps which subject it to the assessment of civil penalties under Section 3008(g) of RCRA, 42 U.S.C. 6928(g). There are potential EJ concerns regarding Respondent's Chester facility. When considering the block group which contains the facility and a one-mile radius around the facility, one or more of the eleven Primary EJ Indexes is at or above the 80th percentile in the nation and state. The area around the facility also exceeds the state average for the percentage of low-income populations and for minority populations. According to the Consent Agreement and Final Order, Respondent is assessed a penalty in the amount of FORTY-FIVE THOUSAND NINE HUNDRED AND EIGHTY-EIGHT dollars ($45,988). The Pennsylvania Department of Environmental Protection participated in February 4, 2020 inspection, has been notified of this action and has raised no objection.
