On February 14, 2023, Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded pesticide by FMC Corporation through the Port of Philadelphia, PA (#1108). It is a violation of FIFRA to sell or distribute misbranded pesticides; the item in question is a registered pesticide that failed to list the EPA product and establishment registration numbers. The importer has the option to export or destroy the violative product and must provide to EPA documentation of the action. The Pennsylvania Department of Agriculture was copied on the NORA. FIFRA misbranding violations are exempt from EJ screen.
