On January 05, 2023, Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded pesticide device by Walmart, Inc. through the Port of Norfolk-Newport News, VA (#1401). It is a violation of FIFRA to sell or distribute misbranded pesticides devices; the item in question is a bug zapper that made a false and misleading claim. The importer has the option to export or destroy the violative product, and must provide to EPA documentation of the action. The Virginia Department of Agriculture and Consumer Services was copied on the NORA. FIFRA misbranding violations are exempt from EJ screen.
