Case summary
On June 20, 2023, Region 3 issued a Notice of Warning (NOW) to Growmark FS, LLC, in response to their alleged major incomplete reporting to EPA. Growmark FS, LLC reported to EPA that their Lewistown registered establishment did not produce pesticides during calendar year 2022. An inspection by the Pennsylvania Department of Agriculture (PDA) on October 13, 2022, demonstrated that Growmark repackaged (produced) the registered pesticide product Gramoxone SL 3.0 (EPA Reg. No. 100-1431). Sales records and production records collected by the PDA inspector show repackaging occuring from at least April 4, 2022, through May 18, 2022. The NOW requires Growmark FS, LLC to respond to EPA explaining how they plan to achieve compliance with FIFRA. The Pennsylvania Department of Agriculture has been notified of this action. Growmark FS, LLC (Lewistown) is not located in an area of EJ concern.
