Case summary
On April 28, 2023, Region 3 issued a Notice of Warning (NOW) to Fisher and Thompson, Inc, in connection with the sale and distribution of the pesticides Zinicin Chlorinated Sanitizer and Mandate Plus . Fisher and Thompson, located in Belleville, PA, sold Zinicin and Mandate with misbranded labels. The labels failed to properly identify the producer of the pesticides and the Mandate label did not identify the container as refillable or non-refillable which has been a requirement since 2011. The NOW requires Fisher and Thompson to respond to EPA explaining how they plan to achieve compliance with FIFRA. The Pennsylvania Department of Agriculture has been notified of this action. Pesticide labeling violations are exempt from EJ screening.
