Case summary
September 20, 2023 EPA Region III filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Tastepoint, Inc. ( Tastepoint ) located at 7800 Holstein Avenue, Philadelphia, PA ( Facility? for alleged violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Pennsylvania Hazardous Waste Management Regulations. The violations were discovered after EPA sent Tastepoint a request for information letter on June 11, 2021. Tastepoint produces flavors, fragrances, and cosmetic actives at the Facility. The violations in the settlement include: (1) operation without a hazardous waste permit or interim status; (2) failure to notify as a large quantity generator of hazardous waste; (3) failure to maintain an adequate contingency plan at the Facility; (4) failure to maintain written hazardous waste management job descriptions at the Facility; (5) failure to provide RCRA training; and (6) failure to submit a biennial report. The Facility is in an area of potential EJ concern. Region 3 notified PADEP, which had no objections to this action. Per the terms of the Consent Agreement, Tastepoint will pay a civil penalty in the amount of $61,840.00.
