Case summary

On September 8, 2023, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA Subtitle I violations and violations of Pennsylvania's underground storage tank (UST) program by Amar Petroleum Inc. and Hans Gill, LLC, as the Tank Owner and UST Operator respectively, of USTs at the Roxy Gas & Snacks facility located at 7728 Ridge Ave., Philadelphia, PA 19128. Region 3's enforcement team, in coordination with PADEP, was able to resolve the UST violations of failing to conduct annual functionality testing of line leak detectors (LLDs) of pressurized pipes and failing to conduct annual line tightness testing (LTT) or monthly line monitoring for pressurized pipes for two (2) USTs from at least 7/3/21 until 4/21/22. The violations were discovered through an UST Compliance Inspection conducted on April 28, 2022. The respondents have agreed to pay a $4,888 penalty and have returned to compliance with the violations.
