Case summary
On August 24, 2023, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against Bashir Naseem Corporation for RCRA I and DC federally authorized underground storage tank program violations at the UST facility located at 1905 9th Street NE, Suite A, Washington, DC 20018 ( Freedom Citgo ). Freedom Citgo is an active gas station with a convenience store on site. At Freedom Citgo there are three 10,000-gallon USTs with gasoline and diesel fuel. The violations alleged include failure to conduct tank release detection for one of the USTs and failure to test the cathodic protection system of two of the USTs. Violations such as these can potentially lead to petroleum product leaks which can be harmful to both human health and the environment. The settlement required the Freedom Citgo to certify that it is now in compliance with applicable UST requirements and to pay a $22,137.50 penalty in accordance with a payment installment plan. Freedom Citgo is located in an area of potential EJ concern. EPA notified the DC Department of Energy and Environment in advance of this action, and the Department had no objections.
