Case summary

On April 4, 2023, EPA Region III entered into a Consent Agreement and Final Order with Valley Milk Products, LLC ( Valley Milk ) resolving an alleged violation of Section 103(a) of the CERCLA against Valley Milk, in connection with Respondent's failure to timely report its July 30, 2021 release of approximately 5,867 pounds of ammonia from its dry, condensed, and evaporated dairy product manufacturing facility in Strasburg, Virginia. Specifically, EPA alleged that Respondent failed to immediately notify the National Response Center ( NRC ) of the ammonia release as soon as Respondent knew, or should have known, that a release of a hazardous substance or extremely hazardous substance had occurred from the facility in an amount equal to or exceeding the applicable reportable quantity, in violation of CERCLA Section 103(a). The Virginia Department of Emergency Management is aware of this action. The settlement requires Respondent to pay $24,024 in civil penalties to resolve the alleged violation.
