Case summary
On 4/28/23 the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA violations and violations of Pennsylvania's underground storage tank (UST) program by Divya Enterprise LLC. Divya Enterprise LLC is the UST owner and operator of three underground storage tanks located in a facility named Sunrise Mart at 1510 Tilghman St., Allentown, PA. Region 3's enforcement team, in coordination with PADEP, was able to resolve the UST violation of failing to conduct monthly release detection testing of one UST from February 1, 2021 until November 29, 2021. The violation was discovered through a UST Compliance Inspection conducted August 16, 2022. The respondent has agreed to pay a $1,222 penalty and has returned to compliance with the violations.
