EPA v. METLAB, INC.

Final Order With Penalty

Case summary

EPA Region III Enters Expodited Settlement Agreement with MetLab Inc. in which the company will pay $8,750 to Settle Penalty Action for RCRA Subtitle C Violations in Wyndmoor, PA. [EPA Docket No. RCRA-03-2023-0029]: On May 16, 2023 Region III entered into a Consent Agreement with, and issued a Final Order to, MetLab Inc settling violations of RCRA Subtitle C that EPA inspectors observed during a Compliance Evaluation Inspection (CEI) at the company's facility in Wyndmoor, PA (Facility). The settlement will ensure that, in the future, the company will properly manage and identify hazardous waste at the Facility. During the CEI the inspector observed multiple containers of hazardous waste rejected for improper identification of hazardous characteristics: a failure to make a hazardous waste determination. The Company has agreed to pay a penalty of $8,750 to settle the enforcement action and refined its procedures for handling waste at the facility. The Consent Agreement and Final Order initiate and resolve this enforcement action. EPA informed PADEP of the action on January 23, 2023 and received no objection.
