Case summary

On September 21, 2023, Region 3 entered into an Administrative Order on Consent with Washington Marina Company ( Marina ) located at 1300 Maine Avenue, SW, Washington D.C. on the Washington Channel. The Marina was previously covered under the 2015 Multi-Sector General Permit ( MSGP ) for Stormwater Discharges Associated with Industrial Activity. During that time, it had failed to submit annual reports, perform routine facility inspections and visual assessments of stormwater discharges, and perform benchmark monitoring sampling. The Marina then failed to submit an NOI for coverage for the 2021 MSGP, and therefore had been operating without a permit since June 1, 2021. During negotiations, the Marina successfully submitted an NOI and became covered under the 2021 MSGP starting on July 12, 2023. Because the 2021 MSGP requires the facility to perform benchmark monitoring sampling as well as other monitoring for the Marina's industrial sector, the Order requires the Marina to develop a sampling plan to submit for EPA's review, and to develop SOPs for conducting sampling, and updating inspection and visual inspection checklists. The D.C. Department of Energy & Environment was informed of and assisted with this enforcement matter. The Marina is in an EJ Community of concern.
