EPA v. AMAZON FULFILLMENT CENTERS
Final Order No Penalty
Case summary
On June 27, Region 3 issued three (3) Notices of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of misbranded pesticide devices imported by Amazon Fulfillment Center through the port of Baltimore, MD. It is a violation of FIFRA to sell or distribute a misbranded pesticide device, and these Air Purifiers were missing the EPA Establishment number of the final place of production. The importer also failed to file a Notice of Arrival or electronic equivalent with EPA. The importer has the option to export or destroy the violative product, and must provide to EPA documentation of the action. The Maryland Department of Agriculture was copied on the NORA, and FIFRA misbranding violations are exempt from EJ screen.
