Case summary
On June 21, Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of misbranded pesticide devices imported by Soulex Float Spa through the port of Baltimore, MD. It is a violation of FIFRA to sell or distribute a misbranded pesticide device, and these UV lights and filters were missing the EPA Estabilshment number of the final place of production. The importer has the option to export or destroy the violative product, and must provide to EPA documentation of the action. The Maryland Department of Agriculture and DC Department of Energy and Environment were copied on the NORA, and FIFRA misbranding violations are exempt from EJ screen.
