The combined unpermitted impacts to these aquatic resources are approximately 17.43 acres of wetland and 2,919 linear feet of stream. Under the terms of the Consent Decree, Defendants agreed to pay a $450,000 penalty split between the United States and Virginia and requires the return to compliance for all three of the sites through injunctive relief in the form of restoration and compensatory mitigation for the impacted streams and wetlands. This matter was referred to EPA by the VADEQ, and Virginia joined EPA as a co-plaintiff to the Consent Decree with claims under the State Water Control Law. The proposed Consent Decree is subject to a 30-day public comment period and approval by the federal district court.
