Case summary

On September 30, 2022, the Director of ECAD entered into an Administrative Order on Consent ( AOC ) with Mingo County Public Service District - Naugatuck in Williamson, Mingo County, WV ( Mingo County or Respondent ) for violations of the Safe Drinking Water Act ( SDWA ) and the applicable regulations set forth at 40 C.F.R. Part 141. Mingo County Public Water System ( PWS ), Identification Number WV3303029, failed to comply with the public water system provisions of Part B of the SDWA, 42 U.S.C. 300g. Specifically, Respondent failed to, among other things, monitor, report and notify for lead and copper sampling and analysis in accordance with 40 C.F.R. 141.86(d)(4)(iv), 40 C.F.R. 141.90, and 40 C.F.R. 141.85(d), respectively. Under the terms and conditions of the AOC, Respondent is required to, among other things, submit to EPA and West Virginia Department of Health and Human Resources (?WVDHHR?) a lead and copper sampling plan for approval, conduct sampling once the sampling plan is approved by EPA and WVDHHR, and report and publish such sampling results. EPA notified the State of WV in advance of taking this action, and the State had no objections. The PWS is located in an area of potential EJ concern.
