Case summary
On August 2nd, 2022, Region 3 filed an Administrative Order on Consent ( AOC ) with Lackawanna College which requires Lackawanna to restore the area of wetlands that were harmed due to the unauthorized discharge of dredged and/or fill material into waters of the United States. In the AOC, Lackawanna agreed to (1) provide to EPA, for review and approval, a restoration plan that includes a construction, maintenance, and monitoring schedule, as well as outlines specific success criteria; (2) provide to EPA, for review and approval, and As-Built Report; and (3) submit to EPA and annual monitoring report by December 31st for at least two years following implementation and for as long as necessary until the project achieves success criteria. EPA has consulted with the Army Corp of Engineers during the development of this action. Lackawanna College is not located within an EJ area.
