Case summary

On August 18, 2022, Region 3 issued an Administrative Compliance Order on Consent ( ACOC ) to Adell Polymers, Inc. ( Respondent ) addressing Respondent's alleged failure to comply with applicable CAA provisions requiring that it apply for, and obtain, a CAA Title V Operating Permit for its thermoplastic compound manufacturing plant located at 115 Potomac Avenue, Petersburg, West Virginia 26847 (the Facility ). In a prior NOVOC, EPA alleged that since at least May 2017, the Facility has had the potential to emit the hazardous air pollutant ( HAP ) Antimony Compounds, and the aggregate potential to emit the HAPs Trifluralin and Antimony Compounds, above major source threshold levels, such that the Facility is subject to CAA Title V regulation and has been operating as a major source without a federally enforceable CAA Title V Operating Permit for the Facility (or a State Synthetic Minor Operating Permit that places physical or operational limitations on its capacity to emit HAPs from the Facility). The actions ordered pursuant to the ACOC include requirements that Respondent submit a complete CAA permit application for the Facility and its operations to WVDEP and comply with prescribed aggregate and combined HAP emissions limits at the Facility prior to Permit issuance. WVDEP was notified about this action. This is not an EJ area of concern.
