Case summary

On September 1, 2022, 2022, the Region and Tony's Corvette Shop, Inc., The Collector Car Museum, LLC and Best Corvette Parts LLC ( Respondents ) entered into a Consent Agreement and Final Order ( CAFO ) that were filed with the Regional Hearing Clerk in settlement and resolution of Respondents? alleged violations of Title II of the Clean Air Act ( CAA ). Respondents collectively own and operate a Corvette repair, maintenance, restoration, and performance modification shop at 7500 Rickenbacker Drive, Gaithersburg, Maryland 20879 (the Facility ) and are subject to CAA requirements that prohibit the sale and installation of devices that defeat vehicle emission controls and of components that bypass, defeat or render inoperative any vehicle emission control devices or elements of design ( defeat devices ). Through its investigation, the Region determined that Respondents manufactured, offered for sale, sold and installed automotive parts and components that rendered inoperative emission control systems on EPA-certified motor vehicles and motor vehicle engines, including: (i) engine control module reprogrammers (also known as tuners ) that disabled emission control systems and/or diagnostic trouble codes (DTCs) on EPA-certified motor vehicles; and, (ii) delete kits ( straight pipes) that removed or bypassed diesel particulate filter and/or selective catalytic reduction systems. The Region determined that between December 22, 2016 and April 22, 2020, Respondents: manufactured and sold 66 defeat device tuners; sold 28 delete device straight pipes; installed all 94 of these defeat device parts in 66 EPA-certified 203(a)(3)(A) and (B), 42 U.S.C. 7522(a)(3)(A) and (B). The Consent Agreement requires the Respondents, jointly and severally, to pay a civil penalty of $135,000 and to certify their current compliance with CAA Title II requirements. The Facility is located in an area of potential EJ concern. EPA has notified the Maryland Department of the Environment (MDE) of this action.
