Case summary
On August 10, 2022, EPA, Region 3 issued an Administrative Order ( Order ) against Potomac Farms LLC. ( Potomac ), a community water system located at 432 Carter Ave Harpers Ferry, WV, alleging violations of the SDWA at its community water system, PWS Identification Number WV3301947. This enforcement action furthers the SDWA's goal of protecting the quality of the nation's drinking water. Potomac's violations include failure to monitor, and report for the Lead and Copper Rule ( LCR ), Arsenic, Inorganic Chemical, Volatile Organic Chemical, Synthetic Organic Chemical, Nitrate, and Stage 2 Disinfection Byproduct for HAA5 and TTHM. Potomac also failed to issue numerous public notifications. The EPA ordered Respondent to: (1) develop and submit a compliance plan to EPA and WVDHHR to reduce nitrate levels below the MCL; (2) issue all overdue public notifications; (3) submit monitoring results for Arsenic, Inorganic Chemicals, Volatile Organic Chemicals, Synthetic Organic Chemicals, Nitrates, LCR and Stage 2 Disinfection Byproducts: HAA5 and TTHM; (4) issue a Consumer Confidence Report to the public; and (5) address deficiencies found in the ground water system. The Facility is located in an area of potential EJ concern. EPA notified the West Virginia Department of Health and Human Services of the action.
