Case summary

On June 8, 2022 EPA Region III filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Nucor Insulated Panels Group LLC t/a Metl-Span) ( NIPG ) located at 6001 Quality Way Prince George, VA 23875 ( The Facility ) which is in an area of potential EJ concern for alleged violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Virginia Hazardous Waste Management Regulations discovered after a joint EPA/VADEQ inspection of the Facility on September 25, 2019. NIPG manufactures industrial metal products and freezer applications at the facility. RCRA gives EPA the authority to control hazardous waste from the cradle-to-grave . This includes the generation, transportation, treatment, storage and disposal of hazardous waste. EPA enforces RCRA to ensure the safe management and cleanup of solid and hazardous waste and supports programs that encourage source reduction and beneficial reuse. The alleged violations at the facility include operating a hazardous waste treatment, storage, or disposal facility without a permit, and failure to conduct weekly inspections of the hazardous waste accumulation area. These alleged violations increase the risk of a release of hazardous waste to the environment. Region 3 notified VADEQ, which had no objections to this action. Per the terms of the Consent Agreement, AMPAC will pay a civil penalty in the amount of $89,619.00.
