Case summary
On September 30, 2022, Region 3 filed a signed Consent Agreement and Final Order ( CAFO ) resolving alleged violations of the CWA and pretreatment standards and regulations by Fleetwood Borough's sewage treatment plant in Fleetwood, PA. The facility is not located in an environmental justice community per EJ screen. In March 2017 and July 2020, Fleetwood's facility had exceedances of the monthly average copper limit. In 2017, 2018, and the first three quarters of 2019, Fleetwood failed to enforce the monitoring requirements against its sole industrial user, Sunsweet Growers. Pennsylvania does not have an approved NPDES pretreatment program, so EPA is the Approval Authority . The Pennsylvania Department of Environmental Protection was informed of this enforcement matter. The Respondent will pay a $15,000 civil penalty. Fleetwood has also taken corrective actions to avoid future exceedances.
