Case summary
On March 10, 2022, the Director of ECAD, Region 3, entered into an AOC with ZQRIC, LLC. ( Respondent ) for violations of its General Virginia Pollutant Discharge Elimination System ( VPDES ) Permit for Domestic Sewage, Permit No. VAG408265 ( the Permit ). Respondent is the owner and/or operator of the Mountain View Motel including its domestic sewage wastewater treatment plant (WWTP) located at 6851 Northwestern Pike, Gore, Virginia (the Facility ). The Facility discharges from its wastewater treatment plant into the Mine Spring Run/Back Creek, a water body impaired for recreation due to bacteria. Violations identified at Mountain View Motel include eight Permit exceedances of the instantaneous maximum limits for both biological oxygen demand (BOD) and total suspended solids (TSS) as well the instantaneous minimum limits for chlorine. Additionally, Respondent has had multiple operation and maintenance (O&M) violations. Respondent has agreed to hire a licensed operator to operate and maintain the WWTP, develop an O&M inspection program and perform quarterly inspections of the WWTP at the Facility. This AOC with injunctive relief is intended to resolve the outstanding violations and return the facility to compliance. The Facility is not located in an environmental justice community per EJ screen EPA has coordinated with VADEQ throughout the enforcement process.
