Case summary
On March 3, 2022, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA violations and violations of Maryland's underground storage tank (UST) program by 4th Elite Corporation. 4th Elite is the UST owner and operator of three (3) underground storage tanks located at Thurmont Liberty gas station in Thurmont, Maryland. Region 3's enforcement team, in coordination with MDE, was able to resolve the UST violations of failing to operate and maintain a corrosion protection system on their three (3) tanks. The violations were discovered through a Compliance Evaluation Inspection conducted by EPA on September 15, 2020, and subsequent information gathering. The respondent has agreed to pay a $2,820 penalty and has returned to compliance with the violations.
