On February 1, 2022, the Regional Judicial Officer issued a Final Order accepting the Expedited Settlement Agreement to settle RCRA violations and violations of Virginia's underground storage tank (UST) program by Empire Petroleum Partners, LLC, aka EPP - Leasing I, LLC, as the owner and/or operator of the underground storage tanks at the Richmond Highway BP facility located at 8263 Richmond Highway Alexandria, VA 22309 during the period of April 25, 2020 to October 1, 2020. Region 3's enforcement team, in coordination with VADEQ, was able to resolve the UST violation of failing to properly conduct tank release detection on one UST. The violation was discovered through information collected during an EPA inspection at the facility on September 29, 2020, and subsequent information gathering. The respondent has agreed to pay a $940 penalty and has returned to compliance with the violation.
