Case summary
On March 23, 2022, EPA Region III entered into a Consent Agreement and Final Order with Victor Abreu Feliz resolving allegations that he had violated the Renovation, Repair and Painting Lead Based Paint rules (RRP) under 40 C.F.R. Part 745, Subpart E, in connection with the renovation of a residential property in Reading, PA. A May 31, 2018 records inspection revealed that at the time renovation work was performed, Mr. Abreu Feliz 1) failed to obtain firm certification to perform, offer or claim to perform renovations or dust sampling for compensation, 2) failed to ensure that all individuals performing renovation activities on behalf of the firm were either certified renovators or had been trained by a certified renovator; 3) failed to provide an adult occupant of the target housing with an EPA-approved pamphlet; and 4) failed to provide documentation of compliance with 40 C.F.R. 745.85 for renovations. These TSCA requirements protect public health and the environment by protecting tenants of potential lead risks in rental properties. The property is located in an EJ Area of Concern. TSCA enforcement is not a state-delegated program, but Pennsylvania was notified of this action. Under the CAFO, Mr. Abreu Feliz will pay a civil penalty in the amount of $2,500 to settle the alleged violations.
