Case summary

On March 17, 2022, the Director of ECAD, Region 3, entered into an AOC with HIWAY MHC, LLC. ( Respondent ) for violations of its Virginia Pollutant Discharge Elimination System ( VPDES ) Permit for Domestic Sewage, Permit No. VA0074942 ( the Permit ). Respondent is the owner and/or operator of a domestic sewage wastewater treatment plant (WWTP) located at 14489 James Monroe Highway, Leesburg, Virginia (the Facility ). The Facility discharges from its wastewater treatment plant into Limestone Branch, a tributary of the Potomac River. Violations identified at the Facility include thirty Permit exceedances of the instantaneous maximum limits for both biological oxygen demand (BOD) and total suspended solids (TSS) as well the instantaneous minimum limits for nitrogen. Additionally, Respondent has had multiple operation and maintenance (O&M) violations. Respondent has agreed to develop and schedule for implementing corrective actions to address the effluent violations, provide a plan and a weekly inspection schedule for the detection, reporting, and removal of all future accumulations of sewage solids, update the Facility's O&M practices and manual accordingly, and provide a plan for the construction completion of a new wastewater treatment plant within 2.5 years of the Effective Date of this AOC. This AOC with injunctive relief is intended to resolve the outstanding violations and return the facility to compliance. The Facility is not located in an environmental justice community per EJ screen EPA has coordinated with VADEQ throughout the enforcement process.
