Case summary

On January 4, 2022, Region III issued an Administrative Order on Consent ( AOC ) to Paul Goodwin Respondent ) for violations of Section 404 of the CWA on a property near Dixie Winds Lane, Bremo Bluff, Virginia 23022 ( Site ), which is owned and operated by the Respondent. The Respondent conducted clearing and earth-moving activity in an attempt to construct an impoundment in approximately 3 acres of wetlands and 1,350 linear feet of stream, without appropriate CWA Section 404 permits allowing for the discharge of fill material into the aquatic resources onsite. EPA conducted an inspection of the Site on February 17, 2021. Following the inspection EPA, issued a Notice of Potential Violation and Opportunity to Confer on April 30, 2021, and began negotiations with the Respondent to attempt to reach resolution through an AOC. After eight months of discussions, agreement on an AOC has been reached to resolve the violations at the Site. As a result, EPA is issuing an AOC. This matter was referred to EPA by the Virginia Department of Environmental Quality and U.S. Army Corps of Engineers.
