Case summary

On June 7, 2022 Region III filed an Administrative Order for Compliance (AO) issued to Resources Preservation, Inc. (f/k/a ARG Resources, Inc.) addressing noncompliance at 375 injection wells (of about 614 injection wells) at its facility, located in the Allegheny National Forest. Even though the wells have been temporarily abandoned since February 2019, Resources Preservation has not plugged those wells or demonstrated nonendangerment of the underground sources of drinking water as required by the UIC regulations and permits. About 77 of the wells have failed the nonendangerment test. In addition, about 73 wells are in noncompliance because they are due for required mechanical integrity tests. The AO will complement a 2020 AO which addressed the rest of the injection wells at the facility, as well as other violations of the UIC requirements. The Region published notice of the proposed issuance of this order, but did not receive any comments. The Region also gave notice to the Respondent of the proposed issues -- Respondent did not request a hearing. EPA administers the UIC program in the Commonwealth of Pennsylvania and has communicated with PADEP regarding the issuance of the AO.
