Case summary

On September 21, 2022, Region III issued an AOC in a matter with Superior Concrete Materials, Inc. ( Superior ) for CWA NPDES permit violations at their facilities located in the District of Columbia. The AOC addresses alleged violations of the NPDES permits issued to the 1721 South Capitol Street and 1601 South Capitol Street facilities ( Facilities ). Violations include discharging without NPDES permit coverage from the 1721 and 1601 South Capitol Street Facilities and failure to comply with sampling, self-inspection and housekeeping requirements at the 1601 South Capitol Street Facility. The AOC requires Superior to submit information to EPA to confirm the implementation and use of a compliance management system at their existing Facility and to certify current compliance. A companion CAFO settles the violations with a civil penalty of $64,000. EPA did not identify this as an area of potential environmental justice concern.
