EPA v. LANE, GARY (CHAMELEON, LLC)

Case summary

On November 23, 2021, Region III issued a Unilateral Administrative Order to Chameleon LLC and Gary Layne for Clean Water Act, Section 404 violations on a property near Ashland, Hanover County, Virginia ( the Site ). The site is a 102-acre previously forested parcel with wetlands next to I-95 that has been developed without appropriate CWA Section 404 permits for discharge of fill material into wetlands onsite. The company's principal, Gary Layne, has conducted grubbing, draining, and clearing on the Site since at least January 2019. EPA executed an Administrative Warrant on April 12, 2021 to conduct a Clean Water Act, Section 404 inspection and, during the inspection, identified approximately 21 acres of unpermitted forested wetland fill caused by the clearing, grubbing, and grading activities. The Site is located in an area of potential environmental justice concern for Virginia. This matter was referred to EPA by the Virginia Department of Environmental Quality and U.S. Army Corps of Engineers.
