Case summary
On December 3, 2021, Region 3 entered into an Administrative Order on Consent with Amsted Graphite Materials, LLC ( AGM ) based in Anmoore, West Virginia, for violations of its wastewater and stormwater NPDES permit. AGM produces carbon and graphite materials with multiple applications in industry. AGM experienced numerous effluent exceedances and stormwater benchmarks exceedances, and poor housekeeping at its facility. As a part of the Order, AGM will comply with a new 2021 NPDES permit issued by the West Virginia Department of Environmental Protection ( WVDEP ) in April 2021, develop Standard Operating Procedures for proper operation and maintenance and good housekeeping practices, update its Stormwater Pollution Prevention Plan ( SWPPP ), remove green product on-site from stormwater exposures, update its Spill Prevention Control and Countermeasure Plane, and submit quarterly reports to EPA for a 24 month period with any updates to the SWPPP, and any exceedances from any outlet with plans to address the cause of these exceedances. WVDEP was informed of this enforcement matter. AGM's facility is not located in an EJ Community of concern.
