On October 13, 2021, Region 3 issued a unilateral administrative order under CAA 113(a)(1) and (4) to Union Center Plaza Management Corp. (UCP), directing the Respondent to apply for a stationary source permit with Washington D.C.'s Department of Energy and the Environment as required under Title 20 of the D.C. Municipal Regulations 200.1-2 as incorporated by reference under the D.C. State Implementation Plan. UCP is the owner and operator of a commercial official space located at 888 First Street NE, Washington, D.C. where the Federal Energy Regulatory Commission is headquartered. The area surrounding Respondent's facility is considered an area of potential EJ concern according to Region III?s EJ Screen protocol. UCP currently operates an emergency rooftop generator at that site without having ever applied for the appropriate permits with D.C's Department of Energy and the Environment. Region III has been in consultation with DC DOEE throughout the course of the investigation and resolution of this matter. DC DOEE will also receive notification of this action upon the effective date of this Administrative Order.
