Case summary

On July 8, Region 3 issued two Notices of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of misbranded pesticide devices imported through the port of Baltimore, MD. The misbranded bug zappers were missing required label information, including the EPA establishment number of the last place of production. It is a violation of FIFRA to sell/distribute pesticidal products which are not properly labelled (i.e. misbranded). The importer has the option to remove the product from the shipment and either destroy it according to federal and local regulations, or to export it to the country of origin; and must demonstrate the product was either destroyed or exported.
