EPA v. GORDON INDUSTRIES, LTD. (COVID-19)
Final Order No Penalty
Case summary
On April 27, Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded pesticide device imported through the port of Pittsburgh, PA. The product was a UV sanitizing box with false and misleading claims that misrepresented the product's efficacy to kill certain bacteria. It is a violation of FIFRA to sell/distribute pesticide devices which are not properly labelled (i.e. misbranded). The importer has the option to export or destroy the product and must provide documentation to show that this action was completed.
