EPA v. ALFA LAVAL DISTRIBUTION, INC. (COVID-19)
Final Order No Penalty
Case summary
On April 21, Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded pesticide device imported through the Norfolk-Newport News, VA. The misbranded spare lamp for UV sterilizers were missing required label information, such as the EPA establishment number of the last place of production. It is a violation of FIFRA to sell/distribute pesticides which are not properly labelled (i.e. misbranded). The importer has the option to remove the product from the shipment and either destroy it according to federal and local regulations, or to export it to the country of origin; and must demonstrate the product was either destroyed or exported.
