On February 9, Region 3 issued a Notice of Refusal of Admission (NORA) to the U.S. Customs and Border Protection to refuse admission of a misbranded pesticide device imported by EMD Performance Material, Corp. through the port of Philadelphia, PA. The pesticide Insect Repeller 3535 was misbranded in that the residue removal statement was missing required information. Sale and distribution of a misbranded pesticide is a violation of FIFRA. The importer has stated they wish to export the product back to the country of origin.
