EPA v. ANTERO RESOURCES CORPORATION (MULTIPLE FACILITIES)

Case summary

DOJ lodged a Consent Decree (Civil Action No.______) between co-plaintiffs EPA and WVDEP, and defendant Antero Resources Corporation (Antero) in the federal district court for the Northern District of West Virginia. The Consent Decree resolves alleged violations of the CAA SIP and federal NSPS regulations at multiple Antero oil and natural gas production facilities located in West Virginia and Ohio. Under the proposed Consent Decree, Antero will perform injunctive relief to assure compliance at 193 of its facilities in West Virginia and 49 of its facilities in Ohio, and both pay civil penalties and mitigate the environmental harm for its past non-compliance. The Complaint, which will be filed concurrently with the Consent Decree, alleges that Antero violated CAA SIP permit requirements and federal NSPS Subpart OOOO/OOOOa regulations at dozens of its West Virginia and Ohio oil and natural gas production facilities. Under the proposed Consent Decree, Antero will pay $3.8 million in civil penalties (split equally between the US and West Virginia) for its past non-compliance. The settlement further requires Antero to set aside $1.5 million toward the permanent plugging and remediation of orphaned and abandoned oil and gas wells over a period of three years, and to change a portion of its well unloading process which will allow the gas to be pushed and processed through normal equipment such as a separator rather than being vented to the atmosphere. Emission reductions from plugging and remediating orphan wells is highly variable. Potential emission reductions is a primary criterion in the selection of wells to be remediated, but other factors such as proximity to populated areas and ease of access to the site are also considerations. VOC reductions will be quantified upon completion of each remediated well. Antero estimates that the well unloading project will result in the reduction of 35 tons of VOCs per year.
