EPA v. TD88 LLC T/A BAYMART (BAYMART LIQUORS)

Case summary

On April 12, 2022, Region 3 issued a Delivery Prohibition (Red Tag) to TD 88 LLC T/A Baymart, the Owner of three underground storage tanks (USTs) located at Baymart Liquors in Annapolis, MD. This action follows the facility failing to respond to an Amended Notice of Intent to Prohibit Deliveries (NIPD) sent to the facility on March 1, 2022 with a deadline of March 30, 2022. The Amended NIPD determined the facility to be in violation of Subtitle I of RCRA, tank and piping release detection requirements. After the facility was Red Tagged, the facility provided EPA with documentation that the agency reviewed, determined the violations noted in the Amended NIPD were corrected, and issued a letter on April 13, 2022 authorizing the Owner or Operator to remove the Red Tags. The facility is not located in an area of potential EJ concern. The Maryland Department of the Environment was informed of this enforcement matter and resolution.
