Case summary

On September 29, 2021 EPA Region III filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against Clean Harbors of Baltimore, Inc. ( CHB ), of 1910 Russell St., Baltimore, MD 22230, for two alleged violations of the Resource Conservation and Recovery Act ( RCRA ) authorized Maryland Hazardous Waste Management Regulations ( COMAR ). CHB is a RCRA permitted hazardous waste collection and transfer facility. RCRA gives EPA the authority to control hazardous waste from the cradle-to-grave. This includes the generation, transportation, treatment, storage and disposal of hazardous waste. To that end, EPA develops regulations, guidance and policies that ensure the safe management and cleanup of solid and hazardous waste, and programs that encourage source reduction and beneficial reuse. The alleged violations were identified during a April 17-24 2018 inspection by EPA. Allegations in the settlement include: (1) failure to comply with Method 21 air monitoring requirements; and (2) failure to prevent open ended lines or valves in equipment used in light liquid service as required by COMAR. Per the terms of the Consent Agreement, Respondent will pay a civil penalty in the amount of $72,243.00.
