Case summary

On August 19, 2021, a Consent Agreement and Final Order entered into by EPA and Solenis, LLC ( Respondent ) was filed with the Regional Hearing Clerk settling alleged violations of the Toxic Substances Control Act. The violations were discovered as a result of a January 30, 2018 inspection and subsequent information gathering activities. As alleged in the Consent Agreement and Final Order, Respondent failed to: submit a pre-manufacturing notice before importing a new chemical substance; submit CDR reports or submit CDR reports within the accuracy standard as required; provide notification of activity before importing a chemical substance designated as inactive on the TSCA inventory; and failed to provide export notifications prior to exporting chemical substances, which subject Respondent to civil penalties under Section 16(a) of the TSCA, 15 U.S.C. 2615(a). The alleged violations have the potential to impede the Agency's ability to collect basic exposure-related information on chemicals in commerce and inform risk screening, assessment, priority setting and management activities. The alleged violations may also prevent information that supports health, safety, and environmental protection related to chemical manufacturing from being collected and evaluated. The area surrounding Respondent's facility is not considered to be in an area of potential EJ concern according to Region III's EJ Screen protocol. According to the Consent Agreement and Final Order, Respondent is assessed a penalty in the amount of FOUR HUNDRED NINETY-EIGHT THOUSAND SIX HUNDRED AND TWENTY dollars ($498,620)). Core TSCA is an EPA direct implementation program. Notwithstanding, DNRECwas notified of this action and has raised no objection.
