Case summary

On August 24, 2021 EPA Region III filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action proceeding against AMPAC Fine Chemicals Virginia LLC ( AMPAC ) located at 2820 North Normandy Drive in Petersburg, VA, for alleged violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Virginia Hazardous Waste Management Regulations discovered after a joint VADEQ/EPA inspection of the Facility on August 8, 2018 and October 23-24, 2019. AMPAC manufactures small batch specialty chemicals at the facility. RCRA gives EPA the authority to control hazardous waste from the cradle-to-grave. This includes the generation, transportation, treatment, storage and disposal of hazardous waste. EPA enforces RCRA to ensure the safe management and cleanup of solid and hazardous waste and supports programs that encourage source reduction and beneficial reuse. The alleged violations at the facility include: failing to conduct a waste determination; operating without a permit or interim status; failing to transfer hazardous waste from a container in poor condition into another container; failing to conduct integrity assessment of a hazardous waste tank; failing to conduct inspections of the hazardous waste storage area; failing to mark equipment subject to RCRA Subpart BB; failing to maintain adequate secondary containment for a hazardous waste tank; failing to maintain land disposal restriction forms; and failing to properly label universal waste containers. Region 3 notified VADEQ, which had no objections to this action. Per the terms of the Consent Agreement, AMPAC will pay a civil penalty in the amount of $59,200.00.
