EPA v. TECH MET, INC.

Case summary

On July 22, 2021, Region 3 filed a signed Consent Agreement and Final Order ( CAFO ) resolving alleged violations of the CWA pretreatment standards and regulations by Tech Met, Inc. ( Tech Met ) with facilities in Glassport and Donora, PA. The facilities are not located in an environmental justice community per EJ screen. Tech Met is subject to the Metal Finishing Category Pretreatment Standards for New Sources at 40 C.F.R. 433.17. Tech Met's facilities experience exceedances of zinc, cyanide, chromium, and nickel discharge limits. Tech Met also had lapses in sampling, reporting, and notifying EPA of exceedances. Pennsylvania does not have an approved NPDES pretreatment program, and the POTWs that Tech Met discharges to do not have an approved POTW pretreatment program, so EPA is both the Approval Authority and Control Authority. The Pennsylvania Department of Environmental Protection was informed of this enforcement matter. The Respondent will pay a $40,000 civil penalty. Tech Met has also taken corrective actions to avoid future exceedances.
